Conditions of Use

1. As a condition of being granted access to the MABEL data, each of the Researcher and the Institution agree to abide by this data release policy and the terms and conditions set out in this Memorandum of Understanding which is intended to be legally binding.

2. The Institution and Researcher each acknowledge and agree that the MABEL data is provided ‘as is’ and the University of Melbourne and Monash University (the MABEL research team) do not warrant the accuracy, quality or fitness for purpose of the data.

3. All publications and presentations using the MABEL data will include the standard acknowledgment:

This [research/publication/presentation] used data from the MABEL longitudinal survey of doctors. Funding for MABEL has been provided by the National Health and Medical Research Council (2007 to 2016: 454799 and 1019605); the Australian Government Department of Health and Ageing (2008); Health Workforce Australia (2013); and in 2017 The University of Melbourne, Medibank Better Health Foundation, the NSW Ministry of Health, and the Victorian Department of Health and Human Services. In 2018 funding is being provided by the Australian Government Department of Health and the Australian Digital Health Agency. The study was approved by The University of Melbourne Faculty of Business and Economics Human Ethics Advisory Group (Ref. 0709559) and the Monash University Standing Committee on Ethics in Research Involving Humans (Ref. CF07/1102 - 2007000291). The MABEL research team bears no responsibility for how the data has been analysed, used or summarised in this [research/publication/presentation]."

4. A copy of any papers and presentations, including conference details, resulting from research using the MABEL data must be provided to us for our records.

5. Access to and use of the MABEL data is permitted only for approved research purposes set out in the application form by the Researcher. The rights to the MABEL data under this MOU are not transferable. If research staff change, then this MOU needs to be signed by the new researcher. Under no circumstances may the data be passed on to third parties.

6. The Institution and Researcher each agree to immediately notify the University of Melbourne if it becomes aware of any unauthorised access to or use or disclosure of the MABEL data.

7. The Institution and Researcher each acknowledge and agree that the University of Melbourne owns all intellectual property rights in the MABEL data.

8. The conduct of all studies using MABEL data must comply with any applicable laws including (without limitation) the Privacy Act 1988 (Clth) as amended from time to time (the Act) and the Information Privacy Principles and National Privacy Principles (as applicable) set out in the Act. The Principles concern the collection, solicitation, security, use and disclosure of personal information. Any person who has access to any personal information pertaining to the project participants must be made aware of, and undertake in writing to abide by the Information Privacy Principles, and the National Privacy Principles contained in the Act. Copies of these documents are available on the Privacy Commissioner’s website at www.privacy.gov.au. State and Territory Privacy Acts may also apply.

9. The Researcher must establish whether ethics clearance is required from their own organisations for the research being undertaken using the MABEL data. The MABEL study was approved by the University of Melbourne Faculty of Business and Economics Human Ethics Advisory Group (Ref. 0709559) and the Monash University Standing Committee on Ethics in Research Involving Humans (Ref. CF07/1102 - 2007000291).

10. Where the results of research using the MABEL data are published or presented in public, information must be presented in a form that does not relate to, or permit the identification of, any individual participant.

11. If the University of Melbourne reasonably believes that the Institution or Researcher are in breach of this MOU or are using the MABEL data other than as specified in the MABEL data application form, the University may terminate this MOU by notice in writing to the Institution and the Institution and Researcher must cease their use of the MABEL data and destroy any copies of it including any derivative data sets.
